Information pursuant to Article 13 of Italian Legislative Decree no. 196/2003 and Article 13 of EU Regulation no. 2016/679
Pursuant to Article 13 of Italian Legislative Decree no. 196/2003 (hereinafter “Law on privacy”) and Article 13 of EU Regulation no. 2016/679 (hereinafter “GDPR 2016/679”), containing provisions on the protection of persons and other subjects concerning the processing of personal data, we inform you that the personal data you provide will be processed in accordance with the above mentioned legislation and the obligations of confidentially applicable to the MUNICIPALITY OF MONTEPULCIANO.
Data controller
The data controller is the Municipality of Montepulciano, with headquarters in Piazza Grande no. 1, 53045 Montepulciano (SI), Italy.
Data protection manager
The data protection manager is the company Esseti Servizi Telematici srl, email: rpd@consorzioterrecablate.it. The data processing manager is the Head of Environmental Services for the Municipality of Montepulciano, Mr Massimo Duchini.
Purpose of the data processing
Personal data will be collected and processed for the following purposes:
– to identify or contact the user for the provision of a service or the execution of the requested operations;
– to allow the user to benefit from a service, for example to receive information about Montepulciano Lake Nature Reserve.
The data may be sent and processed by external companies (i.e. Google Analytics) for the preparation of statistics on site navigation flows.
Processing methods and retention
The processing will be carried out using automatic and/or manual means, by specifically appointed persons, in compliance with the provisions of Article 32 of GDPR 2016/679 and Annex B of Legislative Decree 196/2003 (Articles 33-36 of the Code) on security of processing, and with Article 29 of GDPR 2016/679 on authority for the processing.
We inform you that, in compliance with the “principles of lawfulness”, “purpose limitation” and “data minimisation”, pursuant to Article 5 of GDPR 2016/679, and subject to your free and explicit consent expressed at the end of this notice, your personal data will be kept for the period of time necessary to achieve the purposes for which they are collected and processed.
Scope of communication and diffusion
We also inform you that the data collected will never be disseminated and will not be communicated without your explicit consent, except for the communications that may be necessary for the transfer of data to public bodies, consultants or other subjects, for fulfilment of legal obligations.
Transfer of personal data
Your data will not be transferred either to other European Union member states or to third countries outside the European Union.

Rights of the data subject
At any time, pursuant to Article 7 of Legislative Decree no. 196/2003 and articles 15 to 22 of EU Regulation no. 2016/679, you may exercise the rights to:
a) ask for confirmation of the existence or not of your personal data;
b) obtain information on the purposes of the processing, the categories of personal data, the recipients or categories of recipients to whom the personal data have been or will be communicated and, when possible, the period of storage;
c) obtain the rectification or erasure of the data;
d) obtain the restriction of processing;
e) obtain the portability of the data, i.e. to receive them from a data controller, in a structured, commonly used and machine-readable format, and to transmit them without hindrance to another controller;
f) oppose the processing at any time, including in the case of processing for direct marketing purposes;
g) object to automated decision-making concerning physical persons, including profiling;
h) ask the data controller for access to the personal data and for the rectification, erasure or limitation of the processing, as well as to oppose their processing and to exercise the right of data portability;
i) withdraw consent at any time, without prejudice to the lawfulness of the processing based on the consent given before the withdrawal;
j) lodge a complaint with a supervisory authority.
